MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF PLEASANT VIEW CITY, UTAH
August 8, 2006

Opening prayer, reading or expression of thought: Leonard Call Pledge of Allegiance: Leonard Call Comments or Questions for the Mayor and Council: Diane Hibbard: the small town/open space is disappearing. Is there anything to slow down or preserve it? What is the city council’s responsibility in managing growth? Mayor Wheelwright explained the management of growth through the General Plan, the ordinances with the city council, the planning commission, and the staff as the gate keepers. Protecting private property rights was also explained. It was noted that economic growth is also a responsibility of the city council.
Consent Items: None. Business: 1. Country Fields Subdivision: Request to substitute RE-15 zone amenities. (Presenter: Brent Bailey) Paul Ellsworth: the 40’ setback doesn’t work. They would like to substitute it for a wall along Hwy 89 as a barrier. They chose #10 from the list of criteria in the RE-15 Zone Ordinance. The Orchards Subdivision and County Fields Subdivision walls should be the same type wall. Motion was made by CM Clifford to accept the request to substitute item #10 (barrier wall) for #9 (40’ setback) and that the wall match that of Orchards Subdivision. 2nd by CM Bailey. Voting was unanimous in favor.
2. Hidden Springs Subdivision: Request for Final Approval (Presenter: Bruce Talbot) There are issues that need to be resolved. This item will not be considered tonight. CM Bailey: there were specific concerns of Mrs. Himmelwright that need to be addressed. Bruce Talbot: I will pass along the information to the developers of their promises. CM Clifford: I would like to see a check-off list. Bruce Talbot: the engineer has a check-off list. CM Bailey: we need the information in the packets.
3. Workshop: Sign Ordinance (Presenter: Bruce Talbot) Bruce Talbot: the role of the planning commission is an advisory group to the city council on land use ordinances. The planning commission put the sign ordinance update on the top of the list of things to complete. The proposed ordinance came from South Salt Lake which comes from eight other cities. The original version was 50 pages that the planning commission saw. This is version #5. The guidelines given were residential, billboards limit locations, and Hwy 89 as a restricted area. The city’s marquee would be restricted under this ordinance. It would need to be taken care of in this ordinance. CM Clifford: snipe signs? It needs definitions. CM Bailey: who enforces the ordinance? Bruce Talbot: we don’t have a sign ordinance. If a use is not listed, it is not allowed. CM Clifford: the ordinance is not easy to understand. CM Bailey: it is not user friendly. CM Clifford: are we having problems with signs? Bruce Talbot: no. The decision on signs could be made administratively or legislatively. I would rather have it done legislatively. Mayor Wheelwright: are there specific guidelines in state law. Bruce Talbot: billboards are the only signs regulated in state law. CM Call: I am concerned with freedom of speech issues. Bruce Talbot: we don’t regulate content only the placement of signs. CM Call: protest signs are not allowed. We need to protect those rights. It also concerns me that nothing is allowed unless it is listed. It is a philosophical opinion. We need to really look at this ordinance. CM Clifford: I would start with commercial with the least restrictive regulations and then the law evolves. CM Bailey: we need an ordinance to be clear. We need to be proactive but not this. CM Wheelwright: The council can keep the ordinance here with us and refine it, or send it back to the planning commission with our concerns and suggestions, or set it aside and deal with it another day because this is not a priority, or search for model sign ordinances for small communities, or check other cities’ sign ordinances. It would be interesting to take a look at those. I think it is a mistake to re-invent the wheel. Bruce Talbot has tried to take the best of that. The sign ordinance needs to be enforceable, simple to instruct residents, user friendly, address specific issues, and see of other cities ordinance for a simple approach. CM Bailey: the planning commission has done their job. CM Clifford: what about a citizens committee? Ryan Saunders with Saunders Outdoor Signs: it is not a bad ordinance compared to other cities. We are concerned with billboards. CM Call: I suggest that we each review and check other ordinances. CM Clifford: businesses need a clear definition on what they can and can’t have. Bruce Talbot: the target area is the MP-1 zone. It has no sign regulations. The concept of “if it is not listed it is not allowed” applies to all the ordinances. Mayor Wheelwright: In conclusion we will workshop it at the next city council meeting. We should be prepared to discuss it with a priorities process, line by line. Bruce Talbot heard the list of concerns and he should be prepared to address them, but not create a new draft ordinance. He should have samples from other cities and not necessarily from cities of the same size. Bruce Talbot will present a list of items that need to be completed and we will let the planning commission know which items to work on.
Standing Reports: Councilmember’s reports on their areas of responsibilities Reports from Mayor Wheelwright (WACOG, North View Fire Agency), Councilman Humphreys (Culinary and Secondary Water and Parks), and Councilwoman Ferguson (Beautification and Activities). CM Ferguson: gave an update on the power pole in the roundabout. The last request the power company has on file is a request from Troy Wolverton. They should have a letter from Mayor Wheelwright. Paul Ellsworth: I gave the Eagle Scout a copy of an aerial view of the roundabout for the landscaping plan. Ben Lomond Nursery is helping the scout. The plan will need to be approved by the council. It will take a day to put in the sprinkler system. CM Ferguson: school starts in two weeks and we will lose some help. The youth council has a booth in the Weber County Fair. They will be painting the storage house. There are weeds at the top of 500 W in the ravine. Paul Ellsworth: the prisoners will be working on that. Dave and Leigh Marriott will chair the salmon bake. I hope staff will continue in their areas. Mayor Wheelwright: we need someone to chair the flag ceremony. CM Call: it should be done in conjunction with the breakfast. I would like to be assigned as a representative to the planning commission. Mayor Wheelwright: Rich Jones said it was okay, but I will check with Mike Houtz for a letter regarding the issue.
CM Wheelwright: there is nothing to report on WACOG.
CM Call: the fire agency is getting its 150’ ladder truck this Thursday.
Other Business: CM Clifford: what is happening with the 0-Zone? There was an article in the Sentinel News. Mayor Wheelwright: we have received their proposal on the 0-Zone and we need to respond to it. CM Bailey: has Thompson’s fence issue been resolved? Paul Ellsworth: It has not been decided who pays for what.
Bruce Talbot: there is canal crossing agreement for Deer Crest that has been review by legal. Mayor Wheelwright: does the council feel comfortable with the signing of the agreement? Bruce Talbot: there is no dollar amount. Mayor Wheelwright: only if we mess up. Bruce Talbot: the developer would have to pay for it. The agreement will be put on the August 22, 2006 City Council’s agenda. Bruce Talbot: in reality the majority of the work has been done.
