CITY COUNCIL OF PLEASANT VIEW CITY, UTAH

August 26, 2008

The public meeting was held in the city office at 520 West Elberta Dr. in Pleasant View, Utah, commencing at 6:02 P.M.

Louise Horton: when will there be sidewalks on the west end of Pleasant View Drive? A developer offered to put in the sidewalk and I have not seen it. CM Boeheme: sidewalks have become a big issue. Unfortunately sidewalks were not required in earlier times.

Russell Lee: I live on 4300 N. I am one foot to close to the road. What will happen if the sidewalk goes in? Bruce Talbot: we are waiting for funding to do the design work on 4300 N. We need to figure out the least impact when 4300 N is designed. The sidewalk will stop at Alder Creek Subdivision. It was a requirement for them.

Dick Lee: there is a lot of gravel on 800 W.

Consent Items:
Motion was made by CM Boehme to accept the consent items: a business licenses to Florentino Garcia for the management/rental of apartments and the bills of Pleasant View City. 2nd by CM Ferguson. Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.

Business:
1. Consider entering into a Wholesale Wastewater Treating contract with Central Weber Sewer Improvement District (CWSID).
Mayor Clifford read a letter from James Fisher, City’s representative to CWSID. CM Boehme: why approve the contract before we hear back from Mike Houtz (City Attorney)? Mayor Clifford: we will review this as staff and get back to the city council.
Motion was made by CM Boehme to continue this item pending input from staff and the city attorney. 2nd by CM Walker. Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.

2. Consider adding Hogs-n-Hydrants games to the Pleasant View City Founders Day Celebrations. (Presenter: Jill Anderson)
Jill Anderson presented to the council the idea of adding Hogs-n-Hydrants games to Pleasant View City’s Founders Day. Jill Anderson: I started this in 2004. I’m not in the position to continue this in Harrisville. The cost to the city would be minimal. The city would have to purchase the traveling trophy, the game ball, the use of a city vehicle, staff time to ready the field, and city stationary and postage for donation requests. We sell tickets with a suggested donation. It takes 1 hour to 1 ½ hours for the games. The day and time of the games were discussed. CM Ferguson: has Harrisville been expecting this? CM Boehme: will we be competing with Harrisville? Jill Anderson: Mayor Henricks was favorable of continuing this in Harrisville. CM Ferguson: there could be possible problems with this on Saturday during Founders Day. CM Humphreys: I think it is a great idea. Jill Anderson: it is all in the way of advertisement. CM Walker: we should have CERT do the crowd control. Mayor Clifford: it sounds like we are willing to host this.
Motion was made by CM Walker to add the Hogs-n-Hydrants games to the Founders Day celebration. 2nd by CM Humphreys. Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.

3. Request approval to purchase a replacement vehicle to replace the totaled police vehicle. (Presenter: Scott Jackson)
Mayor Clifford: there was confusion last time on the vote. To clarify, there needs to be a minimum of three votes to pass a motion. Scott Jackson gave his presentation again.
Motion was made by CM Boehme to approve the purchase of a replacement vehicle for the vehicle that was involved in the accident. 2nd by CM Humphreys. Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.

4. Recycling program review. (Presenter: Fred Hellstrom)
Fred Hellstrom reviewed the recycling program. CM Boehme: this is only six months of recycling. We need a years worth of data. I think recycling is the right thing to do. Mayor Clifford: we are right on at $10.00 per month per household fee.

5. Acceptance of bid for the 900 W waterline project between 4300 N and 3925 N. (Presenter: Fred Hellstrom)
Fred Hellstrom: the bid is for a waterline project on 900 W between 4300 N and 3925 N. We received ten bids. The engineer’s estimate was $370,560. The lowest bid was Leon Poulsen at $266,088.40, then Daley at $275,354. It is approximately $104,000 cheaper than the engineer’s estimate. CM Walker: is there a performance bond? Fred Hellstrom: yes. I have the contract for signatures if passed.
Motion was made by CM Ferguson to accept the bid of $266,088.40 from Leon Poulsen for the waterline project on 900 W. 2nd by CM Walker. Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.

6. Consider conditional acceptance and begin the guarantee period for Orchards Subdivision Phases 1 & 2. (Presenter: Bruce Talbot)
CM Walker: it is not on the list, but some developer’s approaches into the subdivisions become weedy and trashy. How is that resolved? Bruce Talbot: through the nuisance regulations. While they are working on the subdivision we can tell them to clean it up. CM Humphreys: this will be a one year guarantee period. Mayor Clifford: the problem will be with item #1 on the list – the trees. CM Humphreys: I’m not in favor of trees in the public way. Bruce Talbot: the ordinance says two trees per lot.
Motion was made by CM Boehme to grant conditional acceptance and begin the guarantee period for Orchards Subdivision Phases 1 & 2 as outlined in the report with a one year guarantee period. 2nd by CM Walker. Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.

7. Consider a Wetland Permitting Proposal and cost estimate for the Wadman Park. (Presenter: Mayor Clifford)
Mayor Clifford: the existing delineation in 2005 is valid. The proposal is to look at the mitigation plan. The cost for the mitigation is $7,680 from Dennis Wenger with Frontier Corporation. One acre of Wadman Park is for a fire substation.
Motion was made by CM Boehme to approve Frontier Corporation to do the Wetland Permitting study in the amount of $7,680 for the Wadman Park. 2nd by CM Humphreys.
Discussion. CM Walker: was there any effort to get more than one estimate? Mayor Clifford: there was an original bid from Bio-West in the amount of $10,000. We have been working with Dennis and tagged them together. There are only three companies that could do this.
Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.

8. Review cost estimates for park restrooms. (Presenter: Paul Ellsworth)
Paul Ellsworth showed the plans for the Pleasant View Park restrooms. Paul Ellsworth: the engineering bid for these plans is $412,000. Laurie Hellstrom: there is only $150,000 budgeted. It would need to be amended. The council reviewed the plans and gave several suggestions for its redesign.

9. Clarify budget item purchases and bidding procedures. (Presenter: Laurie Hellstrom)
Laurie Hellstrom: in the purchasing policy, purchases over $2,000 need to come before the council for approval. Are the items listed in the notes presented during the budget process considered approved or do they still need to come to the council? Does the amount need to be changed? CM Boehme: if it is detailed in the budget, it is okay. Mayor Clifford: I would recommend that we get feedback from staff and check with neighboring cities on purchasing policies.

10. Review of the 2008-09 fiscal year budget. (Presenter: Laurie Hellstrom)
Laurie Hellstrom reviewed the budget with the council. Laurie Hellstrom: for the first month of the fiscal year there are no red flags.

11. Public Hearing - Consider amending the 2008-09 fiscal year budget for the completion of prior year projects. (Presenter: Laurie Hellstrom)
Motion was made by CM Ferguson to open the public hearing to consider amending the budget. 2nd by CM Boehme. Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.
No comments from the public.

Projects and additional information was requested.
Motion was made by CM Walker to continue amending the budget item to the next agenda. 2nd by CM Boehme. Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.

12. Discussion and/or action on renting the basement on holidays. (Presenter: Laurie Hellstrom)
Motion was made by CM Humphreys to amend the policy on renting the basement to clarify that the basement rental is available on all days of the year with an ending time of 1:00 A.M. 2nd by CM Boehme. Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.

13. Consider participation in Tree City USA. (Presenter: Mae Ferguson)
Linda Ries gave a background on Tree City USA, the requirements, and benefits. Mayor Clifford: I would like to see the city staff come back with recommendations.

14. Closed Meeting – Personnel issue.
Motion was made by CM Walker to go into a closed meeting to discuss personnel issues. 2nd by CM Ferguson. Voting aye: CM Boehme, CM Ferguson, CM Walker, and CM Humphreys. Motion passed.

Other Business:
CM Boehme: I thought the sidewalks on Pleasant View Drive were to be done before school started. Paul Ellsworth: the drop deadline is August 29 with a $1,000 per day penalty.

CM Ferguson: we need to have more perennials than annuals in the roundabout.

Mayor Clifford: Dave Evertsen has the first draft on the pay scales. I am asking for help from the council to help review. CM Ferguson and CM Walker volunteered to help review.

Mayor Clifford: the weeds on 1000 W need to be cut. CM Humphreys: I don’t own those lots. CM Boehme: that is a problem in every subdivision with vacant lots.
