MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF PLEASANT VIEW CITY, UTAH
January 8, 2008
The public meeting was held in the city office at 520 West Elberta Dr. in Pleasant View, Utah, commencing at 6:00 P.M.

Pledge of Allegiance: Mike Humphreys Opening Prayer, Reading or Expression of Thought: Mae Ferguson Comments or Questions for the Mayor and Council for items not on the agenda None. 1. Oath of Office and welcome the newly elected Mayor Clifford and City Councilmembers Ferguson, Hjorten, and Walker. Tim Wheelwright welcomed the newly elected officials. Judge Lambert gave the oath of office to the newly elected Mayor Doug Clifford and City Councilmembers Mae Ferguson, Tim Hjorten, and Todd Walker. 2. Recognition of service to Mayor Wheelwright and Councilmembers Call and Bailey. Appreciation was given to Mayor Tim Wheelwright, Councilmember Leonard Call and Councilmember Kevin Bailey. 3. Set procedure to fill the unexpired term of the office of City Council. Mayor Clifford outlined the procedure to fill the unexpired term of the office of city council. Doug Clifford: there were seven applicants for the council position. The applicants are Kevin Bailey, Scott Boehme, Chad Carpenter, Richard Lewis, Greg Schaffer, Michael Wiggle, and John Mason. Each applicant will be given three minutes to give an opening address, followed by questions and answers with one minute response time. We will then let the public make comments. The city council will go into a closed meeting to arrive at the person to fill the position. The meeting proceeded as outlined with each applicant addressing the council. Motion was made by CM Ferguson to go into a closed meeting. 2nd by CM Hjorten. Voting Aye: CM Ferguson, CM Hjorten, CM Walker, and CM Humphreys. Motion passed. Motion was made by CM Hjorten to end the closed meeting. 2nd by CM Humphreys. Voting Aye: CM Ferguson, CM Hjorten, CM Walker, and CM Humphreys. Motion passed. 4. Fill the unexpired term of the office of city council. Mayor Clifford: we have chosen Scott Boehme to be appointed for the two-year position on the city council. Scott Boehme was then sworn in to the position on the city council. 5. Confirm the date, time and place of Pleasant View City Council meetings for 2008 – (2nd and 4th Tuesdays at 6:00 P.M. in the Pleasant View City Offices at 520 West Elberta Drive) Motion was made by CM Ferguson to confirm the date, time and place of Pleasant View City Council meetings for 2008 as the 2nd and 4th Tuesdays at 6:00 P.M. in the Pleasant View City Offices at 520 West Elberta Drive, except the November 11th and 25th meetings are canceled and replaced with a meeting on November 18th. 2nd by CM Boehme. Voting Aye: CM Boehme, CM Ferguson, CM Hjorten, CM Walker, and CM Humphreys. Motion passed.
6. Casey Estates Subdivision - Request conditional subdivision acceptance, located in the area of 1025 W and 3200 N. (Presenter: Bruce Talbot) Bruce Talbot: the council has a staff report. Alan Casey: there is a list of things not completed. I have asked for a list five years ago. I have a lawsuit on the development so I don’t have the as-builts. I have to finish a lot of work not done by the contractor. I don’t feel that these things should stop me from getting conditional acceptance. I thought the conditional period was for one year not two years. It will cost approximately $5,000 to finish the work, not $80,000. The date of the engineer’s letter was August 2007 and I only received it this week. The council discussed the ordinance on conditional acceptance. Bruce Talbot: with conditional acceptance the escrow is released except for 10%. It is held for two years along with the cost of any uncompleted items. Alan Casey: I have done 90% of the improvements. I am not asking for any money. CM Hjorten: there was a lack of communication and the date of the letter was August 2007. CM Humphreys: we could give a starting date and give him time to complete the items, but if they are not completed by the date then we will not honor the starting date. Motion was made by CM Humphrey to grant conditional acceptance for Casey Estates Subdivision with the starting date as of today (1-8-08), subject to completing the list of items (1-8) in Jones and Associates letter dated 8/28/07 by April 1, 2008, and if not, the start date will be the date of completion. 2nd by CM Hjorten. Voting Aye: CM Boehme, CM Ferguson, CM Hjorten, CM Walker, and CM Humphreys. Motion passed. 7. Shady Springs Subdivision – Request conditional subdivision acceptance, located on 550 West between Pleasant View Drive and 3000 N. (Presenter: Bruce Talbot) Chad Stokes: I am concerned with the date on the engineer’s letter which is December 2006. I am asking for a retroactive date and start conditional acceptance back to December 2006. Bruce Talbot: the city council minutes of January 23, 2007 denied conditional acceptance based on the developer agreement and water shares needed. Chad Stokes: in the spring of 2007 we took care Mrs. Thompson’s fence problem. It took time to acquire water shares. We brought those to the city in December 2007. I am asking for at least a six month retro-date. CM Walker: is everything done? Chad Stokes: yes. Motion was made by CM Hjorten to grant conditional acceptance for Shady Springs Subdivision with the starting date of July 1, 2007 for the reason being the items where completed, but there was a problem with communications. 2nd by CM Ferguson. Voting Aye: CM Boehme, CM Ferguson, CM Hjorten, CM Walker, and CM Humphreys. Motion passed.
8. Fox Hollow Subdivision – Request conditional subdivision acceptance, located in the area of 850 W between Pleasant View Drive and 3000 N. (Presenter: Bruce Talbot) Bruce Talbot: the fees are in question by the developer. All the improvements are done. CM Walker: There are a few problems to add to the list. There is a Pine View water valve that is leaking on a particular lot. CM Humphreys: I am aware of it. The lot owner has no right to that Pine View line. It is not our problem. Todd Walker: there is a phone line that was never covered and a sidewalk that has not been fixed. Motion was made by CM Boehme to grant conditional acceptance to Fox Hollow Subdivision with the starting date beginning on the date the payment of the city fees are paid. 2nd by CM Hjorten. Voting Aye: CM Boehme, CM Ferguson, and CM Hjorten. Voting Nay: CM Walker. Abstain Vote: CM Humphreys. Motion passed.
Consent Items: Motion was made by CM Ferguson to accept the consent items (the minutes of December 11, 2007 and the bills of Pleasant View City). 2nd by CM Boehme. Voting Aye: CM Boehme, CM Ferguson, CM Hjorten, CM Walker, and CM Humphreys. Motion passed.
