MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF PLEASANT VIEW CITY, UTAH

None were given. Consent Items: Motion was made by CM Call to approve the minutes of March 13, 2007 and business licenses to Joart B Consulting, LLC, Merlene’s Design, and The Home Automation Guys with the approval of more than one employee that is not a resident of the home. 2nd by CM Bailey. Voting was unanimous in favor. Business: 1. Weber High Senior Class Officers – Request support of Graduation Night. Weber High Officers appeared before the council requesting a $500 donation for a controlled senior class party at Weber High School. Scott Jackson: the alcohol funds could possibly be used. Motion was made by CM Bailey to approve $1000 donation to the senior class party. 2nd by CM Ferguson. Voting was unanimous in favor.
2. Public Hearing – Zone change from A-2 (agriculture) and RE-20 (residential) to RE-15 (residential) on a portion of the Moore property located at approximately between HWY 89 and the North Ogden Canal (3400 N) and between 1150 W and 1250 W for the purpose of a single family subdivision. (Presenter: Bruce Talbot) Motion was made by CM Bailey to open a public hearing. 2nd by CM Humphreys. Voting was unanimous in favor. Bruce Talbot: the subdivision is adjacent to Westview Subdivision and north of Country Fields. It will have to come back for subdivision issues i.e. access. The zoning is okay as long as they understand they still need to go through the subdivision process. CM Ferguson: have the developers chosen the RE-15 items? Bruce Talbot: they have not chosen anyone yet. Mayor Wheelwright asked for any comments from the public. None was given. Motion was made by CM Bailey to close the public hearing. 2nd by CM Ferguson. Voting was unanimous in favor. CM Call: has the applicant seen the staff notes? Bruce Talbot: Essentially, they are the same without the planning commission notes. CM Bailey: is the park area being rezoned? Bruce Talbot: yes. CM Bailey: what if the city decides not to purchase the park property? Bruce Talbot: they would need to acquire and alternate route. Mayor Wheelwright: having the park facility is an ideal situation for the city. It is a win/win situation. It will enhance the property values and the quality of living for all here. Motion was made by CM Call to adopt an ordinance for a zone change from A-2 (agriculture) and RE-20 (residential) to RE-15 (residential) on a portion of the Moore property located at approximately between HWY 89 and the North Ogden Canal (3400 N) and between 1150 W and 1250 W for the purpose of a single family subdivision (Ordinance 2007-4). 2nd by CM Bailey. Roll Call Vote: Voting Aye: CM Ferguson, CM Call, CM Bailey, and CM Humphreys. Motion passed.
3. Public Hearing – Subdivision plat amendment for the purpose of combining White Barn Phase 4 and Pleasant Meadows, located approximately between Pleasant View Drive and 2700 North and between 200 W and 400 W, into one subdivision. (Presenter: Bruce Talbot) Motion was made by CM Bailey to open the public hearing. 2nd b CM Call. Voting was unanimous in favor. CM Ferguson: I live in this area as a homeowner. I will reframe from voting if the council desires so. There were no objections from the council to allow CM Ferguson to vote on this issue. Bruce Talbot reviewed the staff report. Bruce Talbot: we are combining two subdivisions. Physically they are combined and operating as one. Mayor Wheelwright asked for comments from the public. Bob Valentine: After the first denial of this request, we engaged in activities to bring this to fruition. This should not have any impact to homeowners, but it legalizes a process we have been doing for years. We have 100% of the property owner’s signatures. We request this matter to proceed. Motion was made by CM Bailey to close the public hearing. 2nd by CM Humphreys. Voting was unanimous in favor. Motion was made by CM Ferguson to approve the subdivision plat amendment. 2nd by CM Call. Voting was unanimous in favor.
4. Request the purchase of two police vehicles on the State bid for the fiscal year 2007-08. (Presenter: Scott Jackson) Scott Jackson: this is the same spill as other years. I am requesting the approval of two police vehicles in the 2007-08 fiscal year from the State bid which ends in April. We will be replacing two 2002 Impalas and purchasing a Charger and four-wheel drive Dodge pickup truck or whatever has the best resale value. CM Bailey: is there a way to manage to rotate the vehicles more consistently. It is all perception. Scott Jackson: we do this every year. There are ten vehicles in the fleet. CM Bailey: budget four vehicles next year and skip this step. Motion was made by CM Call to approve the purchase of two police vehicles and to look at the suggestion given at budget time. 2nd by CM Bailey. Voting was unanimous in favor.
5. Presentation/Workshop on developing property located above 4300 N. Mayor Wheelwright: this discussion is the Sunset Highland proposal to change the general plan and rezone it to MPC zone. This is a workshop and discussion only. No formal public hearing or legal discussion. There is a formal procedure that it needs to go through. There was a unanimous negative vote from the planning commission on this. There is no action, no promises, just an opportunity for the developer to speak with the city council. 20 minutes will be allotted for this discussion. Ben Howell, developer: I feel this would be a great asset. What concerns do you have in general? How can we help solve problems? It is currently zoned agriculture and we would like to develop it. We feel that there is not a market for 5-acre lots. Mayor Wheelwright: my general comments earlier were: 1 – I’m opposed generally to that that is inconsistent with the General Plan. Our residents have spent a lot of time and thought into it and they were clear about the density above 4300 N. 2 – The MPC zoning was only proposed for one area that is not in the city and only available to a large track of property in exchange for a public benefit to the city. At the time of the MPC, the benefit was a permanent westerly access and dealt with traffic and public safety issue with the trucks. What is the public benefit being offered? Ben Howell: we would come with it. What would that be? CM Call: it is not up to us to come up with the benefit. CM Bailey: we have been over this before on this track of land and the public stated its view as a community what that development would do to the roads. Have you looked at geological maps and the safety of the area? Ben Howell: there was a study done in 1978 by the University of Utah. We are reviewing that and should have a report on the findings. CM Bailey: tell me how to approach my constituents on this? CM Ferguson: 398 lots are a lot of people to get off the roads. Ben Howell: we could eliminate the commercial. Paul Ellsworth: have a meeting with Central Weber Sewer District. I not sure they could handle another 400 lots. Mayor Wheelwright: this goes back to the General Plan. All is based on build out in our General Plan and it goes beyond just the General Plan and would throw everything off. Secondary water is an issue and the alternate system is not built yet. Mayor Wheelwright: we have a pristine bench. All the other benches are being filled up. I am also sensitive that property owners should be able to maximize their return, but my theory is there is huge supply of small acre lots and hardly any larger lots along the Wasatch Front. I think it’s a great opportunity, along with following the General Plan, to maximize your rate of return through design standards for larger lots and a way to make your development consistent with the General Plan. That is how the community wants to see it. Ben Howell: thanks for your time. Mayor Wheelwright: your primary source is the development review committee.
Standing Reports: Councilmember’s reports on their areas of responsibilities 2nd Tuesday: Reports from Mayor Wheelwright (WACOG, North View Fire Agency), Councilman Humphreys (Culinary and Secondary Water and Parks), and Councilwoman Ferguson (Beautification and Activities) CM Humphreys: the recycling bins are over flowing and garbage is being dumped down there. Paul Ellsworth: we are going to burn the pile this April and get more bins down there and maybe lock them up and have open only during specified hours. CM Bailey: Cory Clark has completed his certification. CM Ferguson: YESCO is ready to train on the marquee. CM Bailey: YESCO needs to wire it. CM Ferguson: I am requesting volunteers for Founders Day in the newsletter. CM Call: the playground is a success. CM Bailey: the fencing at the southwest end of Mt. Vineyard needs to be done.
