MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF PLEASANT VIEW CITY, UTAH

May 27, 2008

The public meeting was held in the city office at 520 West Elberta Dr. in Pleasant View, Utah, commencing at 6:00 P.M.

Consent Items:
Motion was made by CM Boehme to accept the consent items: the amended minutes of May 13, 2008 and the closed minutes of April 22, 2008 and a business licenses to Molly Wilcox for a wholesale flower deliver business. 2nd by CM Ferguson. Voting Ayes: CM Boehme, CM Ferguson, CM Hjorten, CM Walker, and CM Humphreys Motion passed.

Business:
1. Final subdivision approval for Alder Creek Subdivision Phase 2. (Presenter: Bruce Talbot)
Bruce Talbot: Alder Creek Phase 2 is located at the top of 500 W and 4300 N. The only issue is the detention basin. They are working to make it happen. They had to rip it out and start over. There is a special approval note on the engineer’s memo that this not to be recorded or construction permits granted until the storm water detention basin in Phase 1 has been constructed and approved. New parties may acquire this subdivision and it may be back for an amendment. This is a cluster subdivision. CM Hjorten: there is a note about interior fire sprinklers being required. Bruce Talbot: if the fire pressure is not sufficient for the size of house then it is required. David Bailey: there is no note on the plat of Phase 1. Mayor Clifford: there is nothing special about that note. We require it on all plats. CM Boehme: what about street lights listed as items #6 & #7 of the engineer’s memo. Bruce Talbot checked the street light locations on the construction drawings. Mayor Clifford: has the city received a letter from Pine View? Bruce Talbot: I have the letter.
Motion was made by CM Boehme to approve Alder Creek Subdivision Phase 2 contingent on staff recommendations. 2nd by CM Hjorten. Voting aye: CM Boehme, CM Ferguson, CM Hjorten, CM Walker, and CM Humphreys. Motion passed.

2. Conditional Use request for a building (garage) in a sensitive area for property located at 4829 Pole Patch Drive. (Presenter: Bruce Talbot)
Bruce Talbot: Rod Porter is out of town and he apologizes. There are no issues. This is in the sensitive area and there are few challenges on this lot. He will add coloring to the metal building to match the home. The planning commission recommends it unanimously. Mayor Clifford: Pole Patch’s Homeowners Association also approved it and it meets their requirements.
Motion was made by CM Hjorten to grant a conditional use permit for a garage at 4829 Pole Patch Drive contingent on the seven items on the Staff Report. 2nd by CM Ferguson. Voting aye: CM Boehme, CM Ferguson, CM Hjorten, CM Walker, and CM Humphreys. Motion passed.

3. Consider amending the motion regarding the time period for the conditional acceptance of the road for Quail Creek Subdivision. (Presenter: Bruce Talbot)
Bruce Talbot: the city council granted conditional acceptance for the road in Quail Creek with a longer guarantee period because certain requirements were not made on the original roadway. The city engineer has since looked at the road. It is not a heavily traveled road. There is no settling of trenches and there has been traffic on the road for four years and we think it is okay. We recommend combining acceptance for the road together with the other improvements. CM Hjorten: Mike, what is your experience on this? CM Humphreys: problems will show up in two years and mostly after the first spring. I don’t think it will have any problems.
Motion was made by CM Hjorten, based on the time period of four years, the city engineer’s recommendation, and our city’s expert, I move to amend the city council motion dated November 14, 2006 to combine the road with the other improvements and have the final inspection in October 2008. 2nd by CM Boehme. Voting aye: CM Boehme, CM Ferguson, CM Hjorten, CM Walker, and CM Humphreys. Motion passed.

4. Award bid for the rock retaining wall of the Pleasant View Drive Sidewalk Project. (Presenter: Paul Ellsworth)
Paul Ellsworth: it has been approved the way it should be. No action taken.

Other Business:
Mayor Clifford: I met with Kelly Woodland from the The Barn Golf Course regarding the walking path on Pleasant View Drive and talked with Mike Houtz. Per the attorney (Mike), neither the city nor the golf course is liable if a walker is hit by a golf ball. The golfer is liable. Discussion continued on a fence along the walking path.

Mayor Clifford: The North View Fire Agency has done an impact fee study. We need to go through the process of approving it. It will be on the June 24, 2008 City Council Meeting.

Mayor Clifford: could we get dress shirt with the city logo on them? CM Hjorten: what about T-shirt with the city logo for residents?

CM Humphreys: dyers woad is out of control. It is easy to fill the bags. Next year we should specify areas on city properties.

CM Walker: is there a plan for restrooms in the park? Paul Ellsworth: I am gather plans for information. CM Walker: what about street signs? Paul Ellsworth: I just got a shipment in and they should be up by next week.

CM Hjorten: the senior center will be in the parade this year.

CM Ferguson: the roundabout planting was to be done by a scout and it has not been done. It was discussed and two days were given to have the project done or the city would complete it. CM Ferguson: we have had a Founders Day Meeting and it is coming along.

Scott Jackson showed the council the bike that was fixed up for the police department.
Bruce Talbot: I am part of the Leagues of Cities and Towns policy committee and I service on two committees with the Wasatch Front Regional Council.
