Comments or Questions for the Mayor and Council for items not on the agenda:
Mike Hallet: there are large-scale marine reptiles in the Pleasant View and North Ogden area. You need to be aware of this and preserve it. I submitted a packet with 52 pages. I haven’t included photos and specimens. They are from 540,000,000 years ago. I would like to set a date with the council and bring in the research project and go to the sites. After discussion, Mayor Wheelwright asked that Mike Hallet check back with Laurie on a work session availability and he ask for someone from the state to attend the meeting.
Consent Items:
Motion was made by CM Call to approve the consent items (business licenses to: Travis Porter for a solicitor license, Cindy Lobato for a pilot service on oversized loads business, Mesha Vieyra for a day care with the exception to allow others outside the home to help, Mark Norcross for a pet waste removal, pet sitting and walking business, Haley Beus for a interior design service business, Tony Pitman for a computer consulting business, and Straw Market for a deli/market, the bill of Pleasant View City, and the minutes of July 10, 2007 and July 17, 2007) 2nd by CM Bailey. Voting was unanimous in favor.
Business:
1. Public Hearing - zone changes from A-2 (agriculture) to RE-15 (residential) on properties located at approximately 1375 W HWY 89 and 1550 W 3125 N for the purpose of single-family subdivisions requested by Don Jones. (Presenter: Bruce Talbot)
Motion was made by CM Humphreys to open the public hearing. 2nd by CM Ferguson. Voting was unanimous in favor.
Bruce Talbot: There are two separate parcels in the same general area owned by the same applicant. CM Bailey: the cul-de-sac looks to long. Bruce Talbot: it will have to be looked at. The maximum is 500 feet. There are a lot of subdivision concerns. This is a zone change request. There is RE-15 all around it. CM Humphreys: why not ½ acre lots? It looks like it could be and there would be more freedom in that zone. CM Bailey: there are surface water issues in that area and now there will be more storm water. During the planning process that will need to be looked at. Bruce Talbot: it is in the staff report. Don Jones: every piece of ground has its own unique problems. Problems will be worked out with engineers. The sketches submitted are not final on what we have to do. We may need to ask for a variance on the cul-de-sac and the extension of Mt. Orchard Drive will need to be addressed to see if it is really required. The master plan shows 1500 W extending to HWY 89 and we will come in perpendicular to it. The ground water is best resolved by landdrains and storm drains. Mayor Wheelwright asked for comments from the public. Glen Dickemore: How many homes on the 8” sewer line? Bruce Talbot: they may have to add sewer lines. It has not been analyzed yet, nor has the subdivision been reviewed. Glen Dickemore: it’s a big concern. I’ll get flooded out and there are too many homes now. I don’t want to see three story homes in my view. Bruce Talbot: the height restriction is 35’ or two and one half stories. Glen Dickemore: we are all ranch style homes. CM Humphreys: if they met the ordinance, they could be built next to yours. Glen Dickemore: we want a fence between us. I’m the only one that got a letter about this meeting. Someone is not doing their job. Mayor Wheelwright: we will look into this. There is no reason to exclude property owners from notices. It was unintentional.
Motion was made by CM Ferguson to close the public hearing. 2nd by CM Bailey. Voting was unanimous in favor.
Motion was made by Clifford to approve the zone changes from A-2 (agriculture) to RE-15 (residential) on properties located at approximately 1375 W HWY 89 and 1550 W 3125 N (Ordinance 2007-10). 2nd by CM Ferguson. Roll Call Vote: Voting Aye: CM Humphreys, CM Bailey, CM Call, CM Clifford and CM Ferguson. Motion passed.
Mayor Wheelwright: Don Jones realizes that the concept and plan are not approved and the infrastructure concerns will be addressed.
2. Consider amending the Parking Ordinance Section 10.16.010. (Presenter: Scott Jackson)
Scott Jackson: there are no references to boats, off-road vehicles, etc in the existing parking ordinance. Chapter 10.16 paragraphs B, E, and G have been changed from vehicle to the broader spectrum. CM Call: some park backwards on the streets. Mayor Wheelwright: it is also a safety concern, not just an appearance issue. It is a health, safety, and welfare issue. Karla Ellsworth: is the parking ordinance also for snow removal? Scott Jackson: that is a different ordinance. Mayor Wheelwright: we are addressing only parking on the street. Some cities are using what is viewable from the street and restricting parking in those areas. We are clarifying what types of vehicles are subject to the parking on the street ordinance. Parking is not an appropriate use of the street, which could be considered open storage.
Motion was made by CM Clifford to amend the parking ordinance (Ordinance 2007-11). 2nd by CM Call. Roll Call Vote. Voting aye: CM Ferguson, CM Clifford, CM Call, CM Bailey, and CM Humphreys. Motion passed.
3. Readdress the speed limit on Pleasant View Drive and 500 W. (Presenter: Kevin Bailey)
CM Bailey: I put this on the agenda at the request of 30 citizens. It was for the safety reason on the truck route. I think we made a mistake. I think 30 mph is right for trucks, but not for passenger cars. CM Clifford: it would cause problems if it is not the same speed for all. It would encourage passing. It’s more dangerous than going slow. 500 W was realigned as a passing road. CM Bailey: Pleasant View Drive has the majority of complaints. Controlling the trucks was the main issue. CM Clifford: school is now in session. Lynette Lewis: parents fly pass and a lot of kids are in danger. Tammy (crossing guard on 500 W) appreciates the 30 mph for the school issue. In my view, cars are coming over the crest to fast. It is a safety issue. Pete Russell: you can’t go down hill at 30 mph, but you can go down in gear at 40 mph. I use the road a lot. Joan Russell: it’s not a safety issue. We have ½ acre lots and we don’t see the kids out there. There are not many roads coming down out of the city, which prior city council’s caused the problem. Let Scott Jackson patrol at 40 mph. We have not had pedestrian/auto accidents. Mayor Wheelwright: part of the concern is the volume of trucks coming off the hill. Historically we have not had that volume in trucks to warrant a decrease in speed limit. There are more homes on the hill and consequently more cars. Since we have connected to North Ogden the traffic has also increased. Portia Stuckey: if Pleasant View’s speed was the same as North Ogden’s, 35 mph, that would be okay. When school is in session the kids come out so fast and out of control. I have seen car and kids almost hit. There is more traffic. Do the math. You only save 30 seconds from driving 30 mph to 40 mph. You need to leave your home 30 seconds earlier. Scott Jackson: if the speed limit is 40 mph, 50 mph is the actual speed. If the speed limit is 30 mph, no one is getting cited at 35 mph. Mayor Wheelwright asked Scott Jackson if we have the ability and resources to study and make recommendation to the city council on the speed limit. Scott Jackson: I will look into it. We could have the truck enforcement officer look into it. Mayor Wheelwright suggested that Scott have the crossing guards, residents that live there, and Lynette Lewis interviewed and have a study for the next meeting. CM Call: those that live on the lower road want a lower speed limit, and those that live higher up on the hill want a higher speed limit. I don’t care about Pleasant View Drive, but 500 West is a different case. Lynette Lewis: if cars are going 40 mph, you can’t get out of the driveway, but at 30 mph you can.
Motion was made by CM Call to return Pleasant View Drive back to the original speed limit and direct Scott Jackson to do a study on 500 W for next meeting. 2nd by CM Bailey. Discussion: CM Humphreys: it is 35 mph to North Ogden. It is hard to go 40 mph, then 30 mph, and then 35 mph. Mayor Wheelwright: there is no curb, gutter, and sidewalk on Pleasant View Drive and the concern of residents that live on Pleasant View Drive, who had asked to please make it safer if we dump traffic to them.
Motion to amend prior motion. Motion was made by CM Call to set the truck speed at 30 mph and the speed for cars back to the original speed. 2nd by CM Bailey.
Discussion on the motion. CM Humphreys: there is still trouble with passing. I would like a study. It is easier to have one speed limit. I don’t know if it is safe. CM Bailey: you still rely on the laws to follow for passing safely. Mayor Wheelwright: I am aware of the public pressure. It is a sore spot with people. I hate to see a willy-nilly change. Think how many hearings and concerns we have heard. We need to stand on what we passed and have a study apart from the convenience issue (we need to get where we want to quicker). I have a concern on changing it. CM Call: It was a last minute decision when it was passed. CM Bailey: This was sponsored by numerous people and I think we made a mistake. Mayor Wheelwright: this may be the opportunity to justify the speed limit given the circumstances.
Voting on the amended motion: Voting Aye: CM Bailey and CM Call. Voting Nay: CM Clifford, CM Ferguson, and CM Humphreys. Motion didn’t pass.
Mayor Wheelwright: I would like to direct staff for a study.
Motion was made by CM Bailey to do a traffic study on the most logical speed limit for Pleasant View Drive and the best, most safe, and correct speed limit for 500 West. 2nd by CM Humphreys.
Discussion on the motion. Scott Jackson: we can gather data, but interpreting it is different. CM Humphreys: a traffic study will take some money. CM Bailey: how was the speed limit changed on 600 West? Paul Ellsworth: the speed limit was reduced on Pleasant View Drive because is was unsafe to pass. It should be left at 30 mph until the trucks are off the street. For those complaining, if one of their kids gets killed, they will be the first to sue the city for changing the speed back up. Scott Jackson: there are equal amounts of people upset. CM Ferguson: maybe it hasn’t been long enough to prove itself. Mayor Wheelwright: we need to look at safety. Joan Russell: the main arterial roads are for moving people. CM Humphreys: it was changed for safety, not for cars. It was changed uniformly so there would be no unsafe practice of passing. We could ask professionals if passing is safe. We could ask the firm that did the truck study about the speed limit, it may not cost as much. Mayor Wheelwright: we already inquired of Interplan. It was impossible for them to render an opinion. Bruce Talbot: they only did a count, not a speed count. There were six areas to set up and it would cost $160 per area. CM Bailey: is the speed limit defendable? We did it without a study. Mayor Wheelwright: it is enforceable up to now. It has not been challenged. This gives us an opportunity to be in a defendable position. Do we want to incur the cost of a traffic study? CM Call: yes, if it wasn’t correctly done in first place. We need to do it correctly. CM Humphreys: I agree. It is safer to lower speed than to raise the speed limit. Richard Lewis: if there were 30 contacts by CM Bailey, how many live in the city? That is less is than 1/100th of the population percentage. How many voted? CM Clifford: we don’t vote democratically on safety issues. Some don’t like the rules, but they are there for a reason and an importance was felt.
Motion was made by CM Bailey to do a traffic study on the area that was just changed on Pleasant View Drive and to establish the recommend speed limit and similar study on 500 West (the truck route). 2nd by CM Humphreys. Voting was unanimous in favor.
4. Recycling discussion.
Mayor Wheelwright: there are currently two recycling bins. Those bins are served by Rocky Mountain Recycling, two days of the week. After some discussion it was decided that a public hearing will be held after the city gathers more concrete information.
5. Request the purchase of fireworks for Founders Day 2008. (Presenter: Paul Ellsworth)
Motion was made by CM Bailey to approve $10,000 in fireworks for the Founders Day 2008. 2nd by CM Humphreys. Voting was unanimous in favor.
6. Acceptance of the scope of work for the 2700 N and HWY 89 master planning and zoning study and authorize the mayor to sign a contract based on the scope of work. (Presenter: Bruce Talbot)
Bruce Talbot: Interplan did the initial study for the corridor planning group under UDOT and they are on their record of bid. They estimated 400 hours to identify accesses and allow us to come up with the master plan to answer access questions with UDOT for the 2700 N plan. Mayor Wheelwright: we have a contractual obligation to look at accesses.
Motion was made by CM Call to accept the of the scope of work for the 2700 N and HWY 89 master planning and zoning study and authorize the mayor to sign a contract based on the scope of work. 2nd by CM Clifford. Voting was unanimous in favor.
7. Approve an agreement between UTA and Pleasant View City on Betterment Improvements at the light rail station. (Presenter: Bruce Talbot)
Brandon Bott with UTA appeared before the council regarding the Betterment Agreement.
Motion was made by CM Call to approve the agreements between UTA and Pleasant View City on Betterment Improvements at the light rail station. 2nd by CM Ferguson. Voting was unanimous in favor.
8. Review and action on the impact fees and expenditures ending June 30, 2007. (Presenter: Laurie Hellstrom)
Laurie Hellstrom reviewed the impact fees and expenditures with the council and noted the exception letter for the Mayor and Public works Director to sign for the unexpended funds from the Storm Sewer Impact fees.
Motion was made by CM Call to authorize the Mayor to sign the letter. 2nd by CM Bailey. Voting was unanimous in favor.
9. Open Meetings training.
Mayor Wheelwright: as mayor, I have the duty to provide training. We will entertain this at a future meeting. I encourage you to read the information.
Standing Reports: Councilmember’s reports on their areas of responsibilities
CM Bailey: There was to be no access on 2700 N for Marsh Construction (Haul-a-day Concrete). Bruce Talbot: it has been placed on the next planning commission’s agenda for clarification.
CM Bailey: There is junk pipe on 2550 N. Paul Ellsworth: it will be hauled away.
CM Bailey: Do we participate in Weber County Fair’s cleanup? Paul Ellsworth: I do, with the city sweeper. We work together. CM Humphreys: Weber County is going to clean out Barker Pond.
CM Ferguson: I’m excited; the marquee is up and there will be training tomorrow.
Mayor Wheelwright: There is a petition for annexation to Weber County for property located at the south of Parkland Business Center to go into Farr West City. We protested. Historically the property was in Pleasant View and in 1972 it was deannexed at the request of Weber County for the creation of the Weber Industrial Park. The city was promised a seat on the board and it was deannexed into Weber County. The case was presented to the Boundary Commission a week ago with the fact that it had been in Pleasant View City. It was a paramount concern but it was superseded by the petitioner’s request to be in Farr West. We lost and the property. It is now Farr West. We need to identify property that overlaps.
