CITY COUNCIL OF PLEASANT VIEW CITY, UTAH

Comments or Questions for the Mayor and Council for items not on the agenda:
Consent Items:
Motion was made by CM Call to approve the consent items (business licenses to: Joshua Pacquing for a carpet installation business and to Mountain View Health Mart Pharmacy with the stipulation that it receives all other required inspections, and the minutes of August 14, 2007 and August 28, 2007 (one open and two closed meetings) 2nd by CM Humphreys. Voting was unanimous in favor.
Business:
1. Adopt an agreement between Pleasant View City and Woods Cross City establishing of quiet zone regarding the commuter rail. (Presenter: Paul Ellsworth)
Paul Ellsworth: when tracks comes through they will not be blowing their horns. Woods Cross City is taking charge of the agreement and we need to pay $400 for them to do the legwork to make this happen. Instead of horns, they would need lights, arms, etc. CM Call: has our attorney reviewed this? Paul Ellsworth: I think the Trust and other attorneys have, but not ours. Mayor Wheelwright: thirteen cities are involved.
Motion was made by CM Ferguson to approve the agreement between Pleasant View City and Woods Cross City establishing of quiet zone regarding the commuter rail. 2nd by CM Call. Voting was unanimous in favor.
2. Consider amending the Alcohol Beverage ordinance.
Mayor Wheelwright: this grew out of a previous discussion. CM Call: I would like to take the sentence ‘in the proximity of a church or school’ out of the ordinance and put in a restriction on advertising and visuals of beer, which we did for the market approval. Mayor Wheelwright: I agree. I’m concerned with the restriction of free speech. On the market, the restriction on advertisement was only an agreement it was not imposed. It was made permissible because the Straw Market agreed to it. CM Clifford: it has the clause that it can be sent to the police chief to make a check. CM Call: that is more arbitrary than before. CM Clifford: remove proximity or we should not have issued the license. CM Call: Farr West denied a license because it was not allowed anywhere. CM Bailey: all of it needs to be reworked before there are any other applicants. CM Humphreys: North Ogden worked hard on their ordinance. Mayor Wheelwright: we can gather sample ordinances and put this on the next agenda as a workshop. We need to look at advertisement restrictions with the city attorney.
3. Discuss a utility bill relief program for military personnel.
Mayor Wheelwright: a resident brought this request in. Some cities across the Wasatch Front took action to waive completely or reduce the amount of utilities for residents who are deployed military. I have a neighbor in Iraq, there is this family, and I assume we have other residents. It is a gesture of support and appreciation to the families. Is this something you could support? If so, can we schedule this for another meeting and invite some of these families to the meeting. CM Bailey: it’s a thank you, not a money thing. CM Clifford: it is a good deal. CM Ferguson: I’m for it. CM Bailey: it should run the course of the entire deployment. CM Wheelwright: we’ll put together the terms and conditions for the next meeting.
4. Request write-off of uncollectible utility bills. (Presenter: Laurie Hellstrom)
Motion was made by CM Call to write-off three utility bills in the amount of $165.57 (account numbers: 1.8015.5, 1.0553.3, and 9.0417.4). 2nd by CM Ferguson. Voting was unanimous in favor.
5. Open Meetings training.
The DVD from Utah Leagues of Cities and Towns will be passed around to the councilmembers.
Other Business:
CM Ferguson: there have been three complaints about the tree in the roundabout.
CM Clifford: someone is doing a lot of blasting. I don’t know which pit it is coming from. Mayor Wheelwright: we will check.
CM Humphreys: the 600 W power poles need to be moved. CM Bailey: the Thompson’s won’t give the property; it will need to be bought. CM Humphreys: we need to get an appraisal.
Mayor Wheelwright: we have the speed study with Interplan with the cost of $6,999.45. The city will also be filing a lawsuit and Jody has asked for any comments from the council within two days. We will be scheduling a Rocky Point meeting.
