Calculating Service Fees
The three main ways that lawyers determine their fees are based on an hourly rate, flat rate, or a contingency rate. The hourly rate and flat rate can vary according to skill and difficulty of the case, so it may be wise to check several offices. The contigency rate is based upon the outcome of a case, and is usually a percentage of the settlement amount.
Apples and Oranges
Just like you would not visit an eye doctor to heal a broken leg, you should choose a lawyer based on their particular skills and education in one field. Many attorneys specialize in certain areas, such as taxes, divorce, bankruptcy, crime or adoption. If you need to select a lawyer for a particular purpose, keep in mind that the family attorney may not have the same experience as one who deals with that issue every day.
Malpractice Insurance
Most state rules or ethics rules require a lawyer to disclose to potential clients whether or not they carry malpractice insurance. If there is not mention in the retainer agreement already, be sure to get a statement in writing from your attorney.
